Acceptance of terms
This Terms of Use Agreement ("Terms") governs your access to and use of QuoteFlash Group LLC's website located at quoteflash.com and all related services (collectively, the "Platform"). By accessing or using the Platform in any way, you agree to be bound by these Terms and our Privacy Policy.
If you do not agree to these Terms, you may not access or use the Platform. If you are using the Platform on behalf of a business, you represent that you have authority to bind that entity to these Terms.
The Platform is intended for individuals at least 18 years of age located within the United States. By using the Platform, you represent that you meet these requirements.
Key definitions
- "Platform" — The QuoteFlash website (quoteflash.com) and all related services provided by QuoteFlash Group LLC.
- "Homeowner" — A User who submits a financing inquiry, submits a project request, or explores options through the Platform.
- "Contractor" or "Pro" — A licensed, insured service professional who registers on the Platform to receive project leads.
- "Lending Partner" — A licensed third-party lender or loan officer to whom QuoteFlash may refer a Homeowner who submits a financing inquiry.
- "Lead" — A Homeowner's request shared with one or more Contractors or Lending Partners who may be interested.
- "User" — Any individual or entity who accesses or uses the Platform.
- "User Content" — Any text, images, reviews, or descriptions submitted through the Platform by a User.
What QuoteFlash is — and is not
QuoteFlash operates a marketing platform that enables Homeowners to submit inquiries and be connected with Lending Partners and Contractors. QuoteFlash is not a party to any loan, service agreement, or transaction between a Homeowner and any Lending Partner or Contractor.
QuoteFlash does not: (a) make, broker, arrange, or service loans, or make any credit decision; (b) perform or subcontract any home services; (c) guarantee the quality, safety, or legality of any Contractor's work; (d) employ Contractors or Lending Partners or create any agency relationship with them; or (e) provide financial, legal, insurance, or investment advice.
Contractors and Lending Partners are independent third parties, not employees, agents, partners, or joint venturers of QuoteFlash. They are solely responsible for their own licensing, insurance, decisions, pricing, workmanship, and compliance with applicable laws.
Financing referrals
QuoteFlash may connect Homeowners with financing options for home projects. QuoteFlash is a marketing and referral service — not a lender, mortgage broker, or mortgage loan originator. We do not make, broker, arrange, or service loans, and we do not make any credit decision.
Submitting a financing inquiry: (a) is not a loan application; (b) is not a commitment to lend or an offer of credit; (c) does not guarantee any loan offer or approval; (d) does not by itself result in a credit inquiry — any credit pull occurs only if and when you choose to apply directly with a Lending Partner; and (e) authorizes QuoteFlash to share your information with one or more licensed Lending Partners.
All financing terms, rates, approvals, and credit decisions are made solely by the Lending Partner. You should independently evaluate any financing offer before making a decision. QuoteFlash may receive compensation from Lending Partners for referrals.
Calls, texts & your consent to be contacted
By submitting an inquiry and checking the consent box on our forms, you provide your prior express written consent for QuoteFlash and its Lending Partners and Contractors to contact you at the phone number and email address you provide — including by automatic telephone dialing system, artificial or prerecorded voice, and SMS text message — regarding your inquiry, even if your number is on a Do Not Call list.
You may revoke your consent at any time by emailing info@quoteflash.com with your name and the phone number to be removed, or by replying with an opt-out request to any text message you receive from us. See our Privacy Policy for full details on how we handle consent and contact preferences.
Homeowner terms
When you submit an inquiry through the Platform, you are requesting to be connected with Lending Partners or Contractors who may be available and interested. Submitting a request does not obligate you to hire any Contractor or accept any financing, nor does it guarantee that any party will contact you.
You agree to provide accurate, complete, and truthful information. You are solely responsible for evaluating any Lending Partner or Contractor, verifying licenses and insurance, negotiating terms, and ensuring work is completed satisfactorily. QuoteFlash provides information to help you make informed decisions but does not endorse, guarantee, or warranty any Lending Partner, Contractor, or their work.
Contractor (pro) terms
Eligibility & vetting
To register as a Contractor, you must be properly licensed, bonded, and insured as required by applicable laws in the jurisdictions where you perform work. By registering, you represent and warrant that you and anyone working on your behalf meet these requirements at all times. QuoteFlash reserves the right to conduct background checks and license verifications.
Independent contractor status
You are an independent contractor and a customer of QuoteFlash. Nothing in these Terms creates an employment relationship, agency, partnership, or joint venture between you and QuoteFlash. You are solely responsible for your own scheduling, taxes, insurance, and legal compliance.
Prohibited conduct
As a User, you agree that you will not:
- Provide false, misleading, or fraudulent information to QuoteFlash, Homeowners, Contractors, or Lending Partners;
- Use automated systems, bots, or scrapers to access or extract data from the Platform without written consent;
- Submit fake requests, fake reviews, or otherwise manipulate the Platform's matching or review systems;
- Harass, threaten, or harm any other User or QuoteFlash personnel;
- Violate any applicable federal, state, or local laws in connection with your use of the Platform;
- Impersonate any person or misrepresent your qualifications, licensing, or insurance status;
- Use information obtained through the Platform for purposes unrelated to the original request;
- Interfere with the security or proper operation of the Platform; or
- Attempt to indirectly undertake any of the foregoing.
User content & reviews
By submitting User Content to the Platform, you grant QuoteFlash a worldwide, royalty-free, perpetual, non-exclusive license to use, reproduce, modify, distribute, and display that content in connection with the Platform and our marketing materials. You represent that you own or have the rights to submit such content and that it does not violate any third-party rights or applicable laws. QuoteFlash may remove User Content that violates these Terms or is otherwise objectionable in our sole discretion.
Intellectual property
All Platform content — including the QuoteFlash name, logo, design, text, graphics, and software — is owned by or licensed to QuoteFlash and protected by applicable intellectual property laws. You are granted a limited, non-exclusive, non-transferable license to use the Platform for its intended purposes only. You may not copy, modify, distribute, or exploit Platform content without QuoteFlash's prior written consent.
Disclaimers
QuoteFlash disclaims all warranties, including: (a) implied warranties of merchantability and fitness for a particular purpose; (b) any warranty that Contractors or Lending Partners are licensed, insured, or trustworthy; (c) any warranty that the Platform will be error-free or uninterrupted; and (d) any warranty regarding the accuracy of profiles, reviews, or financing information.
Any reference to a Contractor being "vetted" or "verified" indicates only that the Contractor completed QuoteFlash's registration and verification process — it is not an endorsement or guarantee of their qualifications or workmanship. You are solely responsible for evaluating and selecting any Contractor or Lending Partner.
Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, QUOTEFLASH SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF YOUR USE OF THE PLATFORM, INCLUDING LOSS OF PROFITS, PROPERTY DAMAGE, OR PERSONAL INJURY.
IN NO EVENT SHALL QUOTEFLASH'S TOTAL AGGREGATE LIABILITY EXCEED ONE HUNDRED U.S. DOLLARS ($100.00). Some jurisdictions do not allow limitations on liability, so the above may not apply to you in full.
Indemnification
You agree to defend, indemnify, and hold harmless QuoteFlash and its affiliates, officers, directors, employees, and agents from and against any claims, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or related to: (a) your use of the Platform; (b) your violation of these Terms; (c) your violation of any third-party rights; (d) any services or financing you perform, receive, or arrange through parties introduced by the Platform; or (e) any inaccurate information you provide.
Arbitration & dispute resolution
Informal resolution first
Before initiating any formal dispute process, contact QuoteFlash at info@quoteflash.com with a written description of your dispute and the relief you seek. Both parties agree to make good-faith efforts to resolve the dispute informally for sixty (60) days before proceeding to arbitration.
Binding arbitration
If informal resolution fails, any dispute arising out of or related to these Terms or your use of the Platform shall be resolved by final, binding arbitration administered by JAMS under its applicable rules, on an individual basis only. The Federal Arbitration Act governs this provision.
Class action waiver
YOU AND QUOTEFLASH WAIVE THE RIGHT TO FILE OR PARTICIPATE IN ANY CLASS ACTION, COLLECTIVE ACTION, OR REPRESENTATIVE PROCEEDING. THE ARBITRATOR HAS NO AUTHORITY TO CONDUCT CLASS OR REPRESENTATIVE ARBITRATIONS.
Exceptions & opt-out
Either party may seek relief in small claims court, or seek injunctive relief in court to protect intellectual property rights. You may opt out of this arbitration provision within thirty (30) days of first accepting these Terms by emailing info@quoteflash.com with the subject line "Arbitration Opt-Out" along with your name and email address.
Governing law & venue
These Terms are governed by the laws of the State of North Carolina, without regard to conflict of law provisions. Any disputes not subject to arbitration shall be resolved in state or federal courts located in Mecklenburg County, North Carolina, and you consent to the personal jurisdiction of those courts.
Modifications to terms
QuoteFlash reserves the right to modify these Terms at any time. Material changes will be posted on the Platform with an updated "Last Updated" date. Changes become effective thirty (30) days after posting. Your continued use of the Platform after that date constitutes acceptance of the updated Terms.
Contact information
These Terms constitute the entire agreement between you and QuoteFlash regarding the Platform. If any provision is found unenforceable, the remaining provisions continue in full force and effect.
