QuoteFlash – Terms & Conditions:
These Terms and Conditions (“Agreement”) govern your use of services provided by QuoteFlash (“we,” “our,” or “us”). By using our services, you (“Client,” “you”) agree to these terms.
1. Services Provided QuoteFlash provides done-for-you outreach campaigns, including but not limited to:Lead reactivation via email and SMSData cleaning and contact organizationCampaign setup and automationOptional services: website design, print design, CRM setup. You grant QuoteFlash permission to send messages on your behalf from designated email or SMS accounts created or approved by you.
2. Customer Data & Consent You affirm that all contacts provided have previously engaged with your business and can be legally contacted under applicable laws (e.g. CAN-SPAM, TCPA). QuoteFlash is not liable for misuse of your contact list or communications made without proper consent. All contact data remains your property and will not be resold, repurposed, or reused outside your campaigns.
3. Payment Terms All services are billed monthly, in advance.Payments are non-refundable, including for partial months or unused campaign volume.Late payments may result in campaign delays or service suspension.
4. Campaign & CRM Access If using our software (e.g. CRM, dashboard), access is provided during your active subscription. Upon termination or non-renewal, access will be revoked and data may be archived or deleted.
5. Term & Termination Minimum commitment: 3 months unless otherwise stated.Either party may terminate after the initial term with 14 days written notice.Early termination may result in loss of setup fees or CRM access.
6. Confidentiality & Non-Compete We agree not to use, share, or retain any of your customer data for use outside your account.We will not compete with your business in your geographic service area during and 12 months after your agreement.
7. Limitation of Liability We are not liable for:Lost revenue from failed campaignsLegal consequences due to client misuse of contact dataDowntime or performance issues caused by third-party tools. Total liability is limited to the amount paid to QuoteFlash in the past 30 days.
8. Governing Law This Agreement shall be governed by the laws of the state of NC, without regard to its conflict of law principles.
